Common Questions about Debt Solutions
Everyone’s situation is different, but here are general answers to the most common concerns:
No. Bankruptcy is reported to the credit agencies, and it will stay on your credit report for up to 10 years. However, most people already have bad credit by the time they file for bankruptcy because they are behind on their bills. By wiping out mounting debts with bankruptcy, you will be able to rebuild your credit quickly after your bankruptcy is final, and enjoy a new financial start.
Many of our clients have found that once they get their unsecured debt discharged, their credit score improves because their debt-to-income ratio has improved so dramatically.
You call us. Come in and we will discuss your options, which depend entirely upon your goals and available income stream.
If you know you cannot afford your home any longer, you can surrender the property in a Chapter 7 filing, and get the underlying mortgage debt discharged – meaning, you are no longer personally liable for that debt.
If you feel you can afford to repay the mortgage arrears over time, then filing Chapter 13 is the way to go. You will have either 3 or 5 years to repay the arrears, after which you will be discharged of your unsecured debt and you can move on as if you never fell behind in your mortgage payments.
If your home is worth less than your first mortgage, you can “strip off” a second (and third!) mortgage and get it discharged as unsecured debt in a Chapter 13 bankruptcy filing. Call us and schedule your free consultation so we can discuss your options.
“Cram down” is when a person files a Chapter 13 petition and tell the auto lender that the car is worth less than what is owed on the loan. The debtor can pay market value at a greatly-reduced interest rate over the life of the Chapter 13 plan (3 or 5 years) and own the car outright upon completion of the plan.
Well, you have several depending upon the amount and type of debt you have and your income stream. Come in for your free consultation and we will discuss how you can immediately use the FDCPA (Fair Debt Collection Practices Act) to stop annoying phone calls. We will also discuss what bankruptcy and other debt relief options can do for you.
